I purchased a product using my Capital One credit card. I never received the product. The seller refused to send me a pre-paid return label. I used my personal funds to pay for the return because Capital One promised to reimburse me for the shipping. Capital One offered to settle with me but required that I sign a w9 tax form which would have made it taxable income. I refused and filed a law suit. The Defendant is not stating that the complaint does not state a claim upon which relief could be granted. I need to respond with a amended complaint that will state the things needed to bypass that motion filed by the defendant.
