Hello, I am looking to hire someone (Preferably a licensed attorney) to help me draft a couple contract templates for different freelance industries such as photography, video production, writing, graphic design, etc. They would be templates, so the format would have to be easy for anyone to edit and input their own relevant information. For example, This contract is governed by the laws of [ENTER STATE OR REGION], in the country of [ENTER COUNTRY].
For reference here are a couple of clauses that I would like to see in an graphic design contract so you have a good idea of what the job would entail:
Rights to display the finished work in graphic designers portfolio.
Specify all of the rights retained by the graphic designer and those granted to the client.
Retain rights to use unused designs in a different project.
Graphic designer promises that except for anything supplied by the client to incorporate into the design all work done by the graphic designer is original and will not be copied from anywhere else. The graphic designer has attained the rights to use any third party content incorporated into the design and does not violate any copyright or trademark.
Notice of confidentiality that no information shared to the graphic designer by the client will be shared or disclosed to any third party except when it may be required by a court or governmental agency.
List of assets needed from client and in what file format the graphic designer will need them in before starting the project.
Exit Strategy - graphic designer will get paid for work done up to a certain point up before the client saying he’s chosen to work with someone else.
What can and can't a client do with graphic designers work.
Jurisdiction clause, any disputes to be settled in the country and state in which the graphic designer resides.
Deliverables (define exactly what is to be delivered).
Time frame of project from conception to completion.
Price and 50% Deposit up front.
Payment time frame. Additional fee’s for late payment.
Set revision limit and charge for extra revisions.
Protect graphic designers intellectual property if someone tried to take their idea to another graphic designer.
Limitation of liability
And of course anything else you would suggest or deem necessary to include.
